Terms of Use
Note: This English text is provided for convenience only. The Turkish version at menuverse.me/terms.html is the legally binding original; in the event of any conflict, the Turkish text prevails.
These Terms of Use (the "Agreement") govern the legal relationship between Menuverse, operated by Ömer Bozkurt as a natural person ("Menuverse", "Operator", "we"), and the user/business ("User", "you") accessing the website, management panel (admin.menuverse.me), QR menu infrastructure and all related digital services (the "Platform") via the menuverse.me domain.
By accessing, registering for or using the Platform, you confirm that you have read, understood and accepted this Agreement. If you do not accept these terms, you must not use the Platform.
1. Parties and Definitions
1.1. Service Provider: Ömer Bozkurt (natural person / sole operator)
Brand: Menuverse
Address: Antalya / Türkiye
E-mail: [email protected]
Menuverse is not a company (Ltd./JSC); the service is provided by a natural person. The related payment and documentation terms are set out in Section 4. Identity details required to issue an expense voucher (gider pusulası) are shared directly with the requesting business.
1.2. Definitions:
- SaaS: Software as a Service — software offered over the internet on a subscription basis.
- Subscription: The User's time-limited right of access to the Platform in exchange for the fee of the selected plan.
- Content: Menu items, product images, descriptions, prices, 3D models and logos uploaded to the Platform by the User.
- End User: The guest/customer who scans the QR menu at the User's venue.
2. Scope of Service
2.1. Menuverse is a SaaS solution offering a digital QR menu, 3D product display, AR (Augmented Reality) preview, table-side digital ordering, multilingual menu management, order and operations analytics, and a menu management panel.
2.2. Menuverse reserves the right to develop, modify, restrict or temporarily suspend the Platform's content, features and technical infrastructure without prior notice. For significant changes, the User is notified by e-mail at least 15 days in advance.
2.3. Temporary interruptions due to scheduled maintenance, hardware/software updates, force majeure or third-party provider outages are not deemed a breach of this Agreement.
3. Account Creation and Security
3.1. To register, you must be at least 18 years old with legal capacity, or act as a person authorized to represent the business.
3.2. Information provided at registration must be accurate, current and complete. Changes must be updated by the User via the panel.
3.3. The User is solely responsible for the confidentiality of account credentials (username, password, API keys) and for all activity carried out through the account. Suspected unauthorized access must be reported to Menuverse immediately.
4. Subscription, Pricing and Payment
4.1. The Platform is offered on a monthly or annual subscription model. Current plans and prices are listed at menuverse.me/en/#pricing. As the service is provided by a natural person, no VAT is applied; the amounts stated are net.
4.2. At the end of a free trial, the account does not automatically convert to a paid subscription; the User's explicit consent is required.
4.3. Payment is made by bank transfer/EFT or via licensed payment institutions. Menuverse does not store card details.
4.4. In case of non-payment, Menuverse reserves the right to suspend service after 7 calendar days of reminders and to close the account after 30 days.
4.5. Price changes are notified by e-mail at least 30 days before the new term; prices are not changed for the current term.
4.6. Payment Documentation (Expense Voucher / Gider Pusulası): Because Menuverse is operated by a natural person, no invoice is issued. The business User documents the service fee it pays through an expense voucher (gider pusulası) it issues itself under the Turkish Tax Procedure Law. Issuing the voucher and any related tax/withholding obligations are the responsibility of the purchasing business and should be assessed with your accountant. The Operator provides the identity details required for the voucher upon request.
5. Right of Withdrawal and Refund Policy
5.1. As a digital content/SaaS service, under the Turkish Consumer Protection Law No. 6502 and the Distance Contracts Regulation, the 14-day right of withdrawal is deemed used once the User begins actively using the service.
5.2. If the User cancels mid-term, service continues until the end of the paid term; no refund is made for the unused period.
5.3. For annual plans, if the service is technically inaccessible for more than 30 consecutive days, a pro-rata refund or extension of the service period is applied.
6. User Obligations and Prohibited Use
While using the Platform, the User undertakes to refrain from the following:
- Uploading content contrary to applicable law, public order, general morality or third-party rights.
- Unauthorized access, reverse engineering, source code decompilation, or data collection via automated bots/scraping.
- Using images, names or marks that infringe third-party intellectual property rights (copyright, trademark, patent).
- Distributing malware, spam or phishing content through the Platform.
- Using the service as an intermediary for products or services whose sale is prohibited.
In case of breach, Menuverse may, without prior notice, suspend the account, remove the relevant content and, if necessary, report to the competent authorities.
7. Intellectual Property Rights
7.1. Menuverse Property: The Platform software, source code, interface design, the "Menuverse" brand, logo, domain, documentation and technical infrastructure belong exclusively to Menuverse and are protected under applicable Turkish intellectual property law.
7.2. User Content: Menu items, product images, logos, descriptions and data uploaded by the User remain the User's property. The User grants Menuverse a worldwide, royalty-free, non-transferable license to use this content solely for providing the service (storage, display, translation, 3D modeling, presentation to end users, backup).
7.3. Menuverse does not use the User's business name or logo as a reference in its own marketing materials without the User's consent.
8. Third-Party Services
The Platform integrates with third-party providers for payment infrastructure, cloud hosting, e-mail delivery, maps and analytics. Each provider's own terms and privacy policies apply; Menuverse is not liable for the availability or quality of third-party services.
9. Disclaimer of Warranties and Limitation of Liability
9.1. The Platform is provided "as is" and "as available". Menuverse makes no express or implied warranty that the Platform will be uninterrupted, error-free, virus-free or fit for a particular purpose.
9.2. To the maximum extent permitted by applicable law, Menuverse's total liability under this Agreement is limited to the total subscription fee paid by the User in the 12 months preceding the claim.
9.3. Menuverse is not liable for indirect damages, loss of profit, loss of reputation, loss of data, business interruption or failure to achieve expected savings.
10. Force Majeure
If performance becomes partly or wholly impossible due to events beyond the parties' control — natural disasters, epidemics, war, terrorism, cyber-attacks (including DDoS), nationwide communications outages or decisions of competent authorities — the affected party is not liable for the duration of such events.
11. Data Protection and Privacy
Personal data of the User and End Users is processed under the Turkish Personal Data Protection Law No. 6698 ("KVKK") and the EU GDPR (to the extent applicable). See the Privacy Policy and Data Protection Notice (KVKK) for details.
12. Term and Termination
12.1. The Agreement enters into force upon registration and continues while the subscription is active.
12.2. The User may cancel the subscription via the panel without notice.
12.3. Menuverse may unilaterally terminate the Agreement without compensation in case of a material breach (including the prohibited uses in Section 6).
12.4. Upon termination, the User may export their data via the panel within 30 days of the closure request. After this period, data is permanently deleted (except records subject to a legal retention obligation).
13. Notices
All notices to the User are sent to the e-mail provided at registration and deemed served. Notices to Menuverse must be sent in writing to [email protected].
14. Changes
Menuverse reserves the right to amend this Agreement unilaterally. Significant changes are announced at least 15 days before they take effect, by e-mail and/or via the Platform. Continuing to use the Platform after notice constitutes acceptance of the new terms.
15. Governing Law and Competent Court
This Agreement is governed by the laws of the Republic of Türkiye. The Antalya Central Courts and Enforcement Offices have exclusive jurisdiction over disputes. For Users with consumer status, the jurisdiction of consumer courts and arbitration committees under Law No. 6502 is reserved.
16. Severability
If any provision of this Agreement becomes invalid or unenforceable, the validity of the remaining provisions is not affected.
